Terms of Service

You must be at least 16 years old and able to enter a binding contract. You are responsible for all activity under your account and for keeping your credentials secure.

You agree NOT to use the Service to:

• Send spam, unsolicited bulk email, or any messages that violate the CAN-SPAM Act, GDPR, CASL, or other anti-spam laws.
• Send phishing, malware, fraudulent, deceptive, harassing, or unlawful content.
• Send to purchased, scraped, or otherwise non-consented contact lists.
• Impersonate any person or entity, or misrepresent your identity or affiliation.
• Bypass Gmail's sending limits, terms of service, or other technical restrictions.
• Reverse engineer, resell, or sublicense the Service without our written consent.

We may suspend or terminate accounts that violate these rules without notice.

You retain ownership of the campaigns, templates, and contacts you upload ("Your Content"). You grant us a limited license to host, process, and transmit Your Content solely to operate the Service. You represent that you have permission to email every recipient you upload.

The Service sends mail through Gmail accounts you connect via Google OAuth. Your use of Gmail is also governed by Google's terms. You are responsible for maintaining the health and reputation of your Gmail accounts and complying with Google's policies.

Paid plans are billed in advance on a recurring basis. You can cancel anytime; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law.

If we offer a free trial, we may modify or end it at any time. After the trial, your account converts to a paid plan unless you cancel.

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE DELIVERABILITY OR THAT YOUR GMAIL ACCOUNTS WILL NOT BE LIMITED OR SUSPENDED BY GOOGLE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINGSMART SENDER WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold harmless KingSmart Sender from any claims, damages, or expenses arising out of Your Content, your use of the Service, or your violation of these Terms.

You may stop using the Service at any time. We may suspend or terminate your access for any breach of these Terms or for any conduct that we believe harms the Service or other users.

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes means you accept the updated Terms.

These Terms are governed by the laws of the jurisdiction in which KingSmart Sender operates, without regard to conflict-of-law principles.
